ShopItUp US — Listing Reporting and DMCA Policy

Effective date: 2026-09-16 · Last updated: 2026-09-16

This Policy explains how to report listings, sellers, and content on the ShopItUp platform at shopitup.us (the "Platform"), and how we handle those reports. It forms part of our Terms of Service, Terms of Sale, and Seller Agreement, and it is the reporting process referred to in the Prohibited and Restricted Items Policy. The Platform is operated by ShopItUp Inc., a Delaware corporation ("ShopItUp," "we," "us").

ShopItUp does not pre-screen listings. Sellers ("Stores") are responsible for what they list. We rely on reports to help us find and act on problems.

1. How to report

What you are reporting How to report
Copyright infringement Send a DMCA notice to our Designated Agent (Section 2)
Trademark infringement or counterfeit goods Email support@shopitup.us (Section 4)
Stolen, unsafe, recalled, prohibited, or fraudulent listings, or a suspicious seller Use the Report this listing link on any listing, or the report form (Section 5)
Privacy concerns support@shopitup.us (see our Privacy Policy)

If you believe someone is in immediate danger, contact local emergency services first.

2. Copyright: Digital Millennium Copyright Act notices

ShopItUp responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA").

2.1 Designated Agent

Send DMCA notices to our Designated Agent:

Copyright Agent ShopItUp Inc. 2810 N Church St STE 90010 Wilmington, DE 19802 Email: support@shopitup.us Phone: 403-478-6577

We accept notices only for copyright claims. Other reports sent to this address may not receive a response.

2.2 What a notice must include

Your notice must be in writing and must include:

  1. your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  2. identification of the copyrighted work you claim is infringed (or, for multiple works, a representative list);
  3. identification of the material you claim is infringing, with enough information for us to find it, such as the listing URL;
  4. your name, mailing address, phone number, and email address;
  5. a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing these elements may not be processed. Before sending a notice, consider whether the use may be a fair use.

2.3 What we do

When we receive a valid notice, we will:

  • remove or disable access to the material promptly;
  • notify the Store, and provide a copy of the notice, which may include your name and contact information; and
  • record the notice for our repeat infringer policy (Section 3).

2.4 Counter-notices

If you are a Store and believe material was removed by mistake or misidentification, you may send a counter-notice to our Designated Agent. It must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before removal;
  3. a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address, and phone number;
  5. a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which ShopItUp may be found); and
  6. a statement that you will accept service of process from the person who sent the original notice, or that person's agent.

What happens next. When we receive a valid counter-notice:

  • we will send a copy to the person who sent the original notice; and
  • we will restore the material between 10 and 14 business days after we receive the counter-notice, unless our Designated Agent first receives notice that the complaining party has filed a court action seeking to restrain the Store from the infringing activity.

2.5 False notices

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. If you are unsure whether material infringes your rights, consider consulting a lawyer before sending a notice.

3. Repeat infringer policy

ShopItUp terminates, in appropriate circumstances, the accounts of Stores and users who are repeat infringers.

  • Strikes. A valid notice that is not successfully countered counts as a strike.
  • Termination. An account that receives 3 strikes within 12 months will generally be terminated.
  • Our discretion. We may terminate sooner, for example for clear or willful infringement or counterfeiting, or decide not to count a notice we believe was sent in error.

4. Trademark infringement and counterfeit goods

If you own a trademark and believe a listing infringes it or offers counterfeit goods, send a report to support@shopitup.us, including:

  1. your name and contact information, and your relationship to the trademark owner;
  2. the trademark, and its registration number and country, if registered;
  3. the listing URLs;
  4. an explanation of why each listing infringes or is counterfeit, for example why the item is not genuine; and
  5. a statement that the information in your report is accurate and that you are the owner of the trademark or authorized to act for the owner.

We may remove listings, notify the Store and share your report with it, and suspend or close accounts. Stores may respond with evidence that the items are genuine or that the use is lawful, for example proof of purchase from an authorized source. We may reinstate listings at our discretion.

5. Other reports, including under the INFORM Consumers Act

You can report listings or sellers that you believe:

  • offer stolen, counterfeit, unsafe, or recalled goods;
  • break our Prohibited and Restricted Items Policy;
  • are fraudulent or misleading; or
  • involve suspicious seller activity.

How to report. Use the Report this listing link that appears on every listing, or the report form, which anyone can use with or without an account. You can also email support@shopitup.us.

Include:

  • the listing URL or Store name;
  • what you believe is wrong; and
  • any supporting information, such as photos, order numbers, or recall notices.

What we do. We review reports and may:

  • remove listings;
  • cancel orders and refund buyers;
  • hold payouts;
  • suspend or close accounts; and
  • refer matters to law enforcement or regulators.

We may not be able to tell you the outcome of every report.

6. Appeals by Stores

If we removed your listing or restricted your account and you believe we made a mistake, reply to our notice or contact us. Include any information that supports your appeal.

For copyright removals, use the counter-notice process in Section 2.4.

7. Our role

ShopItUp may act on reports at its discretion. Removing or not removing a listing is not a legal finding about infringement or anything else. Nothing in this Policy creates an obligation for ShopItUp to monitor the Platform.

8. Changes to this Policy

We may update this Policy from time to time by posting a new version with a new effective date.
